Terms of Use

Effective date: 2 September 2026 · Version: 1.0

These Terms govern use of hushnet.co.ke, including public pages, demonstrations, enquiry tools, downloads and links. HUSHNET operates this Website from Nairobi, Kenya. For general, legal, security or content notices, email info@hushnet.co.ke and use a clear subject line identifying the matter.

1. Scope and acceptance

The Website is primarily an information and business-enquiry channel. It does not by itself purchase a product, create a service level, appoint HUSHNET as a data processor, authorize security testing, or replace a quotation, order, statement of work, licence, warranty, data-processing agreement or other signed agreement.

By using the Website after a reasonable opportunity to read these Terms, you agree to the provisions reasonably applicable to ordinary Website use. Payment obligations, renewals, indemnities, negotiated liability caps and arbitration apply only where separately and conspicuously accepted by authorized parties in a signed or recorded agreement. A footer link, PDF view or enquiry submission does not create a paid-service contract.

Nothing in these Terms removes a right, remedy, duty or liability that applicable law does not permit HUSHNET to remove or restrict.

2. Capacity and organizational authority

You must have legal capacity to use the Website. If you communicate for an organization, you confirm only that you are authorized to discuss that enquiry. You do not bind the organization to a paid agreement merely by contacting HUSHNET. The Website is not directed to children; a person under 18 should not submit an enquiry without a parent, guardian or responsible organization's involvement.

3. Website information and demonstrations

Descriptions, roadmaps, dashboard figures, activity feeds, images, estimated outcomes and coming-soon features are general and illustrative. They are not live customer data, audited results, guaranteed performance, professional advice, a binding quotation or a commitment that a feature will launch. Final scope, price, availability, delivery, acceptance, warranty, support, security and data obligations must appear in an accepted commercial agreement.

HUSHNET may correct errors and change or withdraw Website content prospectively. A Website change does not amend an already signed agreement. Availability, licences, connectivity and delivery lead times may depend on third parties.

4. Acceptable use

You may use the Website for lawful evaluation, procurement research and communication. You must not:

  • attempt unauthorized access to an account, system, network, data, source code or non-public interface;
  • bypass security controls or rate limits, or conduct scanning or penetration testing without signed authorization;
  • introduce malware, destructive code, denial-of-service traffic, abusive automation or deceptive communications;
  • infringe intellectual property, privacy, confidentiality or other rights, or submit unlawful, fraudulent, defamatory, exploitative or misleading material;
  • submit passwords, private keys, payment authentication data, production credentials or unnecessary sensitive personal data through a general form; or
  • misrepresent identity, authority, affiliation, certification, vendor relationship, results or the origin of content.

5. Intellectual property

HUSHNET branding and original Website content, software, layouts, graphics and documentation are owned by or licensed to HUSHNET. HUSHNET grants a limited, revocable, non-exclusive, non-transferable permission to access the public Website and keep material expressly made available for internal evaluation. No other licence is granted.

Third-party names, products and marks belong to their owners. References on this Website identify platforms that HUSHNET can discuss, source, deploy or support for an organization's requirements.

6. Enquiries, submissions and feedback

Information submitted through a contact or demonstration form is handled under the Privacy Policy. General forms are not a secure channel for credentials or highly sensitive information. An enquiry does not require HUSHNET to accept work, reserve capacity, provide a quotation or assume confidentiality beyond applicable law and an express written obligation.

You retain rights in an enquiry. You authorize HUSHNET to receive, route, protect, assess and respond to it. If you deliberately submit non-confidential product feedback, excluding customer and personal data, HUSHNET may use that feedback without payment.

7. User content and takedown

Any text, file, image, review, comment, feedback, data or other material you submit remains yours. You grant HUSHNET a limited licence to host, copy, transmit, format, secure, review and moderate it as reasonably necessary to provide the requested function, respond to an enquiry, enforce these Terms, protect people or systems and comply with law.

That licence does not authorize unrelated advertising, sale, public case studies, client-name or logo use, or general-purpose model training. A testimonial, public case study, customer name, logo, image or metric requires separate authorization.

For copyright, trademark, privacy or unlawful-content reports, email info@hushnet.co.ke with subject CONTENT NOTICE, your contact details and authority, the exact affected material or URL, the right or rule involved, supporting information, requested action and a good-faith confirmation. HUSHNET may restrict, preserve, review or remove material where reasonably necessary for safety, security, rights enforcement or legal compliance.

8. Third-party services and operational claims

The Website may link to email, WhatsApp, social media, hosting, mapping, vendor or other third-party services. Their terms and privacy practices apply after you choose to leave the Website. HUSHNET is not responsible for independent third-party content, availability or security.

Cybersecurity, surveillance, telematics, GPS, backup, incident-response and automation statements describe capabilities dependent on the agreed design, configuration, customer cooperation and third-party infrastructure. No security or positioning service can guarantee prevention or detection of every event, continuous or exact location, theft recovery, accident prevention, emergency response or a verified handoff.

9. Disclaimers and liability

To the maximum extent permitted for a free informational Website, the Website is provided on an “as available” basis. HUSHNET does not promise uninterrupted, error-free or vulnerability-free access, a future feature, or the accuracy of illustrative content.

Subject to non-excludable rights and only where legally permitted, HUSHNET is not liable for indirect or consequential loss arising solely from use of the free public Website, including lost profit, revenue, opportunity, goodwill or anticipated savings. These public Terms do not impose a monetary cap through browsing or an enquiry submission; paid services require separately accepted commercial risk-allocation terms.

Nothing excludes or limits liability to the extent it cannot lawfully be excluded or limited, including fraud, non-waivable consumer remedies, applicable data-subject or regulator claims, or another mandatory liability.

10. Governing law and disputes

These public Website Terms are governed by the laws of Kenya, without overriding mandatory protections that lawfully apply. Before a non-urgent Website claim, a party should send written notice identifying the issue and requested relief and allow 30 days for good-faith discussion where practical.

A qualifying non-consumer B2B dispute may be referred to final arbitration under the Nairobi Centre for International Arbitration Rules only where authorized parties separately and conspicuously accept that clause in the relevant commercial agreement. The seat is Nairobi, Kenya, the tribunal is one arbitrator and the language is English, unless the accepted agreement says otherwise.

Nothing here prevents a consumer from using a statutory or court remedy that cannot be waived, an individual from contacting the Office of the Data Protection Commissioner, a regulator from acting, a competent forum from hearing a matter, or either party from seeking urgent interim relief where permitted.

11. Changes and contact

HUSHNET may update these Terms prospectively by publishing a new effective date and version. A materially adverse change does not retroactively alter an accrued claim or signed agreement. To request an earlier version or send a notice, email info@hushnet.co.ke.
